1. Agreement
Progress is operated by Catch Recap LLC ("Progress", "we", "us"). By accessing or using Progress, you agree to these Terms. If you use Progress on behalf of a company or organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Accounts and Access
You are responsible for maintaining control of your account and for all activity that occurs under your account. Progress uses email code sign-in to verify identity. You must provide accurate account information and promptly secure your account if you suspect unauthorized access.
Workspace access is controlled by membership, role, and feature settings. You must not access or attempt to access workspaces, projects, files, messages, or integrations unless you are authorized to do so.
3. Your Content
You keep ownership of content you create, upload, import, record, or connect to Progress, including project data, chat messages, notes, files, recordings, signatures, links, and integration data. You grant Progress a limited license to host, process, transmit, display, reproduce, and use that content only as needed to operate, secure, support, and improve the service.
You are responsible for ensuring that you have the rights and permissions needed to upload, connect, share, or process content through Progress.
4. Google and Third-Party Services
Progress can connect to third-party services such as Google, Spotify, AI providers, and hosting or storage providers. Your use of those services may be governed by their separate terms and privacy policies. You authorize Progress to access and use connected service data only as needed to provide the features you enable or request.
You can revoke Google access through Google Account permissions. Disconnecting or revoking an integration may limit or disable related Progress features.
5. AI Features
Progress may use third-party AI providers to summarize, draft, classify, search, or take requested actions on your behalf. AI outputs may be incomplete, outdated, or incorrect. You are responsible for reviewing AI outputs and approving important actions before relying on them.
Do not use AI features as a substitute for professional legal, medical, financial, security, or compliance advice.
6. Acceptable Use
You agree not to misuse Progress. Prohibited conduct includes:
- Violating laws, regulations, contracts, intellectual property rights, privacy rights, or security rights.
- Uploading malware, attempting unauthorized access, probing systems, or disrupting the service.
- Using Progress to send spam, phishing, deceptive, harassing, or unlawful communications.
- Importing or sharing content you do not have rights to use.
- Attempting to reverse engineer, scrape, resell, or abuse Progress or its APIs except where allowed by law.
- Using Progress to make automated decisions that require human review under applicable law without that review.
7. Plans, Fees, and Changes
Progress may offer free, beta, internal, or paid plans. If paid plans are introduced, fees, renewal terms, cancellation terms, taxes, and payment details will be presented at checkout or in the applicable order terms. We may change, suspend, or discontinue features as the app evolves.
8. Privacy
The Privacy Policy explains how Progress collects, uses, shares, and protects information. By using Progress, you acknowledge the Privacy Policy.
9. Suspension and Termination
We may suspend or terminate access if you violate these Terms, create risk for the service or other users, or if required by law. You may stop using Progress at any time. Some terms will continue after termination where their nature requires it, including ownership, privacy, disclaimers, liability limits, and dispute provisions.
10. Disclaimers
Progress is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted or error-free operation.
11. Limitation of Liability
To the maximum extent permitted by law, Progress and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities. Our total liability for any claim related to Progress will be limited to the greater of the amount you paid for Progress in the three months before the claim or 100 US dollars.
12. Indemnity
You will defend, indemnify, and hold harmless Progress and its operators from claims, damages, liabilities, costs, and expenses arising from your content, your misuse of the service, your violation of these Terms, or your violation of laws or third-party rights.
13. Disputes
These Terms are governed by applicable United States law, except where your local law requires otherwise. Before filing a claim, you agree to contact [email protected] so we can try to resolve the issue informally.
14. Changes to These Terms
We may update these Terms as Progress evolves. If changes are material, we will provide notice when required. Continued use of Progress after updated Terms become effective means you accept the updated Terms.
